1. Agreement to Terms
By placing an order with Jingle Canada, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
Jingle Canada provides custom jingle creation services. Each order includes a 30-second custom jingle with vocals and a matching instrumental track. Bilingual options (English and French) are available for an additional fee.
3. Pricing and Payment
Our pricing is as follows:
- Standard jingle (English or French): $699 CAD + HST
- Bilingual jingle (English and French): $899 CAD + HST
Payment is split into two installments: a 50% deposit at the time of order and the remaining 50% balance due upon delivery of the completed jingle. All payments are processed securely through Stripe.
4. Delivery and Revisions
We aim to deliver your custom jingle within 5-7 business days of receiving your order and deposit. Delivery times may vary based on workload and complexity. We offer reasonable revisions to ensure your satisfaction. Major changes to the creative direction after initial delivery may incur additional fees.
5. Ownership and Usage Rights
Upon full payment, you receive full ownership rights to your custom jingle for use in your business marketing, advertising, and promotional materials.
Important: License to Jingle Canada
By placing an order, you grant Jingle Canada a perpetual, non-exclusive, royalty-free license to use your completed jingle, business name, and logo for promotional purposes, including but not limited to:
- Featuring your jingle in our "Samples" section on our website
- Including your business in "Our Clients Include" or similar client showcase sections
- Using excerpts in marketing materials, social media, and advertising
- Demonstrating our services to prospective clients
This license allows us to showcase our work while you retain full ownership and usage rights for your business purposes.
6. Refund Policy
The initial deposit is non-refundable once work has begun on your jingle. If you are not satisfied with the final product after reasonable revisions, we will work with you to find a solution. Refunds of the balance payment may be considered on a case-by-case basis.
7. Client Responsibilities
You are responsible for:
- Providing accurate business information and creative direction
- Responding to communications in a timely manner
- Ensuring you have the right to use any materials you provide (logos, taglines, etc.)
- Completing the balance payment upon delivery
8. Intellectual Property
You warrant that any materials you provide (business name, logo, taglines, etc.) do not infringe on any third-party intellectual property rights. You agree to indemnify Jingle Canada against any claims arising from materials you provide.
9. Limitation of Liability
Jingle Canada's liability is limited to the amount paid for services. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or your jingle.
10. Governing Law
These Terms and Conditions are governed by the laws of the Province of Newfoundland and Labrador, Canada. Any disputes shall be resolved in the courts of Newfoundland and Labrador.
11. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
